Attorney for Rep. Eric Swalwell Stands Firm Against Sexual Misconduct Claims in Fiery Interview: ‘It Raises Questions’
During a contentious interview Saturday morning, attorney Elias Dabaie defended Rep. Eric Swalwell (D) against multiple allegations of sexual misconduct, questioning the motives behind the claims made by several women. The timing of these allegations, surfacing just 25 days before the California gubernatorial election, raised significant concerns for Dabaie.
“I’m evaluating the credibility of these claims and the timing, and it raises questions,” Dabaie stated during his conversation with Elex Michaelson, emphasizing the proximity of the allegations to the election date.
The initial claim came from a former staffer who alleged that Swalwell sent her explicit images and solicited nude photos while she was employed by him in 2019 at the age of 21. She also accused him of sexually assaulting her on two occasions when she was incapacitated.
Following this, CNN reported additional accusations from three other women who had interacted with Swalwell via social media. Despite these serious allegations, Swalwell has categorically denied any wrongdoing.
Dabaie faced tough questioning from Michaelson regarding whether he believed all the accusers were fabricating their stories. “Many of these allegations are from women who claim that the incidents occurred years ago. Evidence suggests that some of these women have previously reached out to the congressman, expressing support for his campaign and even asking for job references,” he argued.
Michaelson countered Dabaie’s assertions, referencing established patterns noted by sexual assault experts, who often indicate that victims may maintain contact with their perpetrators. This point added complexity to the discussion surrounding the allegations.
The allegations have ignited criticism from within Swalwell's own party, with some members urging him to withdraw from the gubernatorial race. Nevertheless, Dabaie affirmed Swalwell's commitment to continue his campaign.
“The idea that all these individuals have rescinded their support seems politically motivated,” Dabaie suggested, hinting at potential strategies within the Democratic party aimed at consolidating votes ahead of the primary elections. However, Michaelson interjected, questioning the rationale behind former supporters urging Swalwell to step down.

“That doesn’t make sense,” he asserted, pointing out that these were not just political opponents but some of Swalwell’s closest allies in Congress.
As the interview progressed, Dabaie described the situation as a potential “rush to judgment,” indicating that the unfolding narrative around Swalwell’s candidacy is far from settled.
