Judge Probes Legitimacy of Trump’s $10 Billion IRS Lawsuit
A federal judge is demanding clarity from both the Justice Department and President Donald Trump’s legal team regarding the legitimacy of his $10 billion lawsuit against the Internal Revenue Service, an agency under his purview as president.
In a recent order, U.S. District Judge Kathleen Williams raised concerns about whether a genuine dispute exists, emphasizing that a case must demonstrate “adverseness” between the involved parties. “Typically, adverseness is found in a situation where one party is asserting its right and the other party is resisting,” she noted. “Consequently, if there is no adverseness, there is no case or controversy.”
The Constitution stipulates that federal courts can only adjudicate actual “controversies.” Williams has mandated both parties to clarify “whether a case and controversy exists” by May 20, with a hearing scheduled for May 27 in Miami.
This order arrives as both sides are attempting to resolve the matter amicably. In a joint filing last week, attorneys for Trump and the IRS requested a 90-day pause in proceedings to facilitate discussions aimed at reaching a resolution.
Trump initiated the lawsuit against the IRS and the Treasury Department in January, claiming that the agency failed to prevent the unauthorized release of his tax documents by a government contractor. This contractor, Charles Littlejohn, was sentenced to five years in prison in 2024 after pleading guilty. Trump contends that the IRS did not take adequate measures to safeguard against such breaches.
While Williams acknowledged that Trump filed the lawsuit in “his personal capacity,” she pointed out that “he is the sitting president and his named adversaries are entities whose decisions are subject to his direction.”
The IRS directed inquiries regarding Williams’ order to the Justice Department, which, along with the White House, has not yet responded to requests for comments.
Acting Attorney General Todd Blanche refrained from discussing the case's status during an unrelated press conference earlier this week but did address how the Justice Department navigates cases with “competing interests.”
“The Department of Justice handles complicated decisions involving those types of issues every day, all day,” Blanche stated. “You have decisions that an attorney general or their staff must make that are difficult and complicated, and we do it.”
Williams was appointed to her position by President Barack Obama in 2011. Trump has indicated that any financial gains from this lawsuit would be donated to charity, although those funds would ultimately derive from taxpayer dollars.
The complaint against the IRS, filed by Trump alongside his sons Donald Trump Jr. and Eric Trump, as well as the Trump Organization, claims that the leak resulted in “reputational and financial harm” and “public embarrassment.” This lawsuit follows a report revealing that Trump paid only $750 in federal income taxes in 2016 and 2017.
