Manhattan DA Probes Sexual Assault Claims Against Rep. Eric Swalwell
New York City prosecutors have launched an investigation into sexual assault allegations against Democratic Representative Eric Swalwell from California, a development that has significantly impacted the ongoing California governor's race.
The Manhattan District Attorney's Office confirmed the inquiry on Sunday, urging survivors and anyone with pertinent information to reach out. "Our specially trained prosecutors, investigators, and counselors are well-equipped to help you in a trauma-informed, survivor-centered manner," a spokesperson stated.
Initial reports of the allegations surfaced on Friday through a local publication, detailing claims made by a former staff member regarding her interactions with Swalwell both in California and New York. The investigation by the Manhattan DA's office was first reported by another news outlet.
The unnamed former employee of Swalwell's district office in Castro Valley alleged that he began pursuing her shortly after her hiring. She claimed that Swalwell sent her inappropriate images via Snapchat, solicited nude photos, and requested sexual acts in a parking lot. Following a night out for drinks in September 2019, she recounted waking up naked in his hotel room with scant memory of the events.
Years later, in 2024, after her tenure with Swalwell had ended, she alleged that during a meeting for drinks post-charity gala in New York, she became heavily intoxicated. She recalled resisting his advances and asserting "no" while he allegedly forced himself upon her. The next morning, she reported experiencing vaginal bleeding and bruising.
The publication noted that it reviewed text messages sent by the woman to a friend three days after the incident, where she described being "sexually assaulted" by Swalwell.
As pressure mounts from House Democrats for Swalwell to withdraw from the gubernatorial race, he has firmly denied the allegations, labeling them as false. "These allegations are false and come on the eve of an election against the frontrunner for governor," Swalwell asserted in a statement. "For nearly 20 years, I have served the public—as a prosecutor and a congressman—and have always protected women."
Swalwell further emphasized his intention to focus on his family during this tumultuous time while defending his record against what he termed lies. He also hinted at potential legal action against the accuser.
The political ramifications of these allegations have unfolded rapidly. House Democratic leaders issued a statement on Friday evening calling for an expedited investigation and urging Swalwell to cease his campaign immediately. They emphasized the need for accountability without explicitly demanding his resignation from Congress.
"This is unacceptable of anyone—certainly not an elected official—and must be taken seriously," stated House Minority Leader Hakeem Jeffries along with Whip Katherine Clark and Caucus Chair Pete Aguilar. "All perpetrators of sexual assault and harassment must be held accountable."
In response to the allegations, Florida Republican Rep. Anna Paulina Luna has announced plans to initiate a vote aimed at expelling Swalwell from Congress, with a potential vote occurring as early as midweek.
