FBI Chief Patel Takes Aim at 'The Atlantic' with $250 Million Lawsuit

Apr 21 2026

FBI Director Kash Patel has launched a $250 million lawsuit against The Atlantic, ignited by an article that alleged his drinking habits have raised concerns among government officials. The lawsuit, filed on April 20, follows a series of high-profile firings within the Cabinet, including Attorney General Pam Bondi and Homeland Security Secretary Kristi Noem, which have left Patel feeling increasingly paranoid about his own position.

Sources close to the situation suggest that Patel's erratic behavior, as reported in the April 17 article, has become a focal point of concern. The Atlantic claimed that his drinking had led to instances of obvious intoxication and erratic conduct in front of White House officials, prompting Patel to assert that the sources cited were "not in a position to know the facts."

In a pointed response, Patel's lawsuit contends that the article is part of a calculated smear campaign against him. "The Article itself reveals that Defendants understood their sources were animated by hostility," the suit states, highlighting the reliance on "former advisers" and "political operatives" as sources with potential biases.

Moreover, Patel's legal team argues that The Atlantic failed to provide him an opportunity to refute the claims before publication, disregarding a pre-publication letter that outlined inaccuracies and offered counter-evidence. "This is not negligence. It demonstrates a deliberate and malicious smear," the filing asserts.

The Atlantic has responded robustly, labeling the lawsuit as "meritless." A spokesperson for the publication stated, "We stand by our reporting on Kash Patel, and we will vigorously defend The Atlantic and our journalists against this meritless lawsuit."

Reporter Sarah Fitzpatrick noted that her sources characterized Patel's behavior as a "national security vulnerability," raising alarms about potential exploitation by adversaries. Despite Patel's claims of fabrication, there have been public instances of him consuming alcohol, including a February incident in Italy where he was filmed celebrating with the U.S. men's Olympic hockey team.

This particular episode reportedly drew the ire of President Donald Trump, who expressed his displeasure during a phone call with Patel, according to two officials familiar with the conversation.

Patel, confirmed as FBI director in February of last year, took to social media to address the situation, framing the lawsuit as part of an ongoing conflict with The Atlantic. "See you and your entire entourage of false reporting in court... But do keep at it with the fake news; actual malice standard is now what some would call a legal layup," he posted on X.
