Outrage Erupts as HOA Demands Removal of American Flags Ahead of Independence Day

Patriotic Californians are furious after their homeowners association ordered them to take down their American flags just days before the nation's 250th anniversary.

A married couple and their neighbor in San Marcos, San Diego County, received threats of $100 fines if they did not remove their flags. The HOA's aggressive stance has escalated since the 2024 election, targeting those who display Old Glory on their properties.

The Cookes and their neighbor, Terri Collins, expressed outrage over the HOA's actions, noting that many in the area have already succumbed to the pressure and taken down their flags. The average home price in their neighborhood hovers just under $1 million.

In a shocking letter from before the 2024 election, the HOA board claimed the flag represented a "political or affiliative view" that would "degrade the common area." This assertion has sparked intense backlash from residents.

Amy Cooke, a supervised visitation monitor for children, stated, “We are outraged. If you want to fly your flag, fly it. This is America. We are the land of the free and home of the brave; this is crazy.”

She emphasized that the American flag symbolizes freedom and criticized the HOA's mindset. The Cookes have displayed the flag for 20 years, honoring Chris Cooke's grandfather, Alexander Christie, who died in World War II.

Christie was killed during the 1944 Battle of Leyte Gulf, a pivotal naval battle against Japan where his ship, the USS Princeton, sank. He received a Navy Purple Heart and Navy Cross for his valor. Chris shared that his mother was just one month old when her father died, highlighting the profound generational impact of his sacrifice.

The conflict with the HOA intensified around the 2024 election when they restricted flag displays to "exclusive use" areas like backyards, prohibiting them in common areas such as front yards.

The HOA's letter stated that allowing flags in common areas would lead to other owners wanting to express political views through flags, resulting in degradation of shared spaces.

Following this, the Cookes faced fines for displaying their flag outside their home, citing its size and location as violations. The Freedom to Fly the American Flag Act passed in 2005 prohibits HOAs from banning flag displays but allows them to regulate how flags are shown.

Terri Collins has flown her flag for 35 years and received similar notices from the HOA. She noted that their neighborhood is deeply patriotic due to its proximity to the old Miramar Navy Base, where many Top Gun pilots lived.

Collins asserted that differing political opinions should not dictate flag displays. She plans to purchase a giant flag despite the HOA's threats. She claimed that most board members are not pro-American, with only two members supporting flag displays.

The HOA's letter and fines have intimidated some neighbors into removing their flags. Collins observed that flags have been taken down one by one over recent months, leaving only her and the Cookes still flying theirs.

Collins declared, “I’m not taking my flag down. They can fine me $100, $200, $1,000; I’m not paying it.”

The Cookes have secured a 15-minute Zoom hearing with the HOA board. If they fail to convince them to retract their demands, they plan to launch a crowdfunding campaign to hire legal representation.

Chris Cooke stated, “We’ve never sued anyone in our life. We’re just here to fly our flag and be left alone. There’s enough division; we shouldn’t have to do this. But we don’t want to be pushed into submission.”

Despite the HOA's actions, both the Cookes and Collins intend to celebrate Independence Day and America's 250th birthday with traditional festivities including pool time, card games, barbecues, and fireworks.

California gubernatorial candidate Steve Hilton criticized the HOA's stance, questioning their motives just before such a significant national celebration. He emphasized that showing love for America should unite people rather than divide them.

Hilton urged residents to ignore the HOA's demands and increase their display of American flags during this important anniversary for the nation.

The Ambiance HOA did not respond to requests for comment regarding this situation.
