Trump Faces Legal Action Over Alleged Presidential Records Act Violations

A lawsuit has been initiated against former President Donald Trump, following a controversial memo from the Justice Department that labels the Presidential Records Act as “unconstitutional.” This memo implies that Trump may possess the legal power to eliminate White House records at will.

Filed on Monday by the American Historical Association and American Oversight, the lawsuit accuses Trump and his administration of exploiting the Office of Legal Counsel to justify the destruction or withholding of records from the National Archives and Records Administration (NARA) upon leaving office.

“Currently, the Administration asserts that the President is legally permitted to obliterate records of his official government actions or even sequester them for personal use,” the lawsuit contends.

According to the allegations, Trump operates under the belief that government records are “personally owned” by him.

“In the Administration’s perspective, records documenting the official activities of the President and nearly 1,000 White House staff—created with taxpayer money, on government property, concerning official business—are personally owned by the President, not the American populace. This is not government for the people, by the people, and of the people,” it states.

The Justice Department's memo released on Wednesday argues that the Presidential Records Act lacks a “valid legislative purpose” and exceeds preservation authority, asserting that Congress cannot mandate the preservation of presidential records solely for historical reasons.

In their legal action, American Historical Association and American Oversight emphasize that Trump must adhere to federal recordkeeping laws and safeguard the historical record that rightfully belongs to the American public before it is irretrievably lost.

The memo from Wednesday raises significant concerns, particularly in light of Trump’s previous actions involving White House documents. After his departure from office in 2021, he retained multiple boxes of official records instead of transferring them to NARA.

“NARA ultimately retrieved 15 boxes containing thousands of documents from President Trump’s personal residence at Mar-a-Lago,” the lawsuit highlights.

Numerous boxes were eventually discovered at Trump’s Florida resort, with some stored in a bathroom and even on the shower floor.
